Terms of Service

By creating an account or using KloudLytics ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree, do not use the Service.

KloudLytics provides an agentless AWS Cloud Security Posture Management platform that analyses your AWS environment using read-only IAM roles and generates security findings, posture scores, and remediation guidance. The Service is provided on a subscription basis and is subject to the plan limits described at the time of purchase.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@kloudlytics.com if you suspect unauthorised access. We are not liable for losses caused by unauthorised use of your account.

You must provide accurate registration information and keep it up to date. Accounts registered with false information may be suspended without notice.

You may use the Service only for lawful purposes and in accordance with these Terms. You must not:

–Use the Service to scan AWS accounts you do not own or have explicit written authorisation to audit–Attempt to reverse-engineer, decompile, or extract the source code of the Service–Circumvent rate limits, authentication mechanisms, or access controls–Resell, sublicense, or redistribute access to the Service without our written consent–Use the Service in a manner that disrupts or degrades its availability for other users

You grant KloudLytics permission to assume the IAM role you create in your AWS account for the purpose of running security scans. This access is read-only. You remain solely responsible for the IAM role's configuration, trust policy, and permissions. You may revoke access at any time by deleting or modifying the IAM role in your AWS account.

KloudLytics collects and stores AWS resource metadata as described in the Privacy Policy. You retain ownership of all data collected from your AWS environment.

KloudLytics and its licensors retain all intellectual property rights in the Service, including the software, user interface, security check logic, and documentation. Nothing in these Terms transfers ownership of any intellectual property to you.

You retain all rights to data you provide to the Service, including AWS scan data and any content you upload.

Paid plans are billed in advance on a monthly or annual cycle. All fees are non-refundable except where required by applicable law or expressly stated in a written agreement. You may cancel your subscription at any time; your access continues until the end of the current billing period.

We reserve the right to change pricing with 30 days' written notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that security findings will be complete or accurate.

KloudLytics is a security-analysis tool. It is your responsibility to review, validate, and act on findings. We do not guarantee that use of the Service will result in a secure AWS environment.

To the maximum extent permitted by applicable law, KloudLytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

You agree to indemnify and hold harmless KloudLytics and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Service or other users. You may terminate your account at any time via the account settings or by contacting support@kloudlytics.com. Upon termination, your data will be deleted in accordance with the Privacy Policy.

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.

We will notify you by email at least 14 days before any material change to these Terms takes effect. Continued use of the Service after that date constitutes acceptance of the updated Terms. For non-material changes (such as clarifications or typo fixes), we may update the Terms without notice.
